My car isn't covered but in the recent cold weather I get a tail lights out (both) warning on startup that goes away after 10 seconds or so, and one time it stayed on till I shut the car off and turned it back on.... Thoughts?

Ok, so our non-ZHP E46 ('02 325i) has false brake light failure warning lights. Constantly lit, not intermittent. Recall procedure done by local BMW dealer in 2012. Both right and rear brake lights and tail lights are all working perfectly, as is the 3rd brake light up at the top of the rear window.
Sounds like the problem is HERE but am wondering if anyone else has experienced this, post-recall. If so, warranty repair?
Ideas?
