Yes they are passively cooled. I wouldn't think that would of caused them to go bad especially after only using 15 times or so. At $150 per set I don't think I will take a chance and buy another set of these.

Do the gigs have cold bulb check? That killed the LED angel eye bulbs in the X5
The passive cooling isn't the issue - it's probably just the choice of components. The OE X5 fogs I have worked absolutely perfectly, and those were also passively cooled. I only brought it up because you mentioned the orientation of the lights. Being upside down shouldn't really affect the termal performance of it to any noticeable degree, I was just mainly curious about cooling method.
E46 fogs are not monitored by the CANBUS system, so no need to code out hot/cold checks or worry about resistors.

I just ordered a set of BMW X5 LED's from The Retro fit source for $60 shipped. Going to attempt to McGuyver them into the OEM E46 fog light housings! I love the CREE LED fogs I have now but at $150 per set and one already went bad I need to figure something else out.
