Probably shouldn't need either, but rolling your fenders is worth it in the long run. I'd highly recommend you do it for the sake of fitting the wheels in want sans choosing different wheels.
In the market for an E90 M3
You will not have any issues. Stock height has alot of room.

I have the D-force LTW5 in 17x8.5, ET40. Have run them with 245/40/17 and 255/40/17 tires. No rubbing of fenders at stock height. Once I was on coilovers, if I put it too low in the rear, it would rub part of the outer fender (above the lip) in hard turns. In front, at full lock the shoulder of the 255/40/17 tire would rub slightly on inner wheelwell (not fenders) with a 5mm spacer. I don't know if that's ride height dependent, but am pretty sure using a 10mm or 12mm spacer up front would have eliminated the problem. Going to 245/40/17 tires also eliminated rubbing at full lock.
Thanks for the info. I went ahead and ordered them last night found an awesome deal on modbargains for the 17x9 ideally I wanted 17x8.5 but it was about $400 extra (not on sale). Ill be running 245/40/17 all around. Once installed ill come back and update on fitment incase anyone in the future wants to do this setup

Look forward to hearing more. I'm thinking of getting 17x9 wheels in the future, either D-force LTW or Apex Arc-8.
Yeah apex was my first choice, but got the dforce for such a good deal couldn't let them go
